If he drove off with the baby, I would have gotten in my car, and with my cell phone, called the police while I followed him. This way he wouldn't get away. But no, I wouldn't have fired (especially with the kid there).

These laws and what you can sue for sickens me. Who the hell thinks up of these laws? All these stories about being charged for self defence. While they just passed a bill in Florida (or somewhere in the states) that you can not only carry a concealed weapon in public, but you are also allowed to draw and fire the weapon "if you feel threatened". Imagine all the money that state is going to rack in for charging people just because they used a law.

And ArgentLupe, what exactly did the judge want you to do in that situation? Say to the drunk "Just stay here so I can go and get my baseball bat, I will be right back, don't move. We can take off from where we left off."

I was just talking with my family on the phone, and someone came to my door. I opened it up and it was a woman who lives on the second floor. She wanted to make sure I was ok, and that I wasn't in trouble with the cops. She agreed that the guy was crazy, and that I did the right thing.

It's strange hearing everyone say that... I told my sister (who's in her 30's) and she almost flipped out... but after explaining the whole situation she told me that I did a good job diffusing a dangerous situation.

I don't know... the shock is wearing off now after having told the story so many times, and I'm just now thinking about what had just happened. I still think I did a good job... but something is nipping at me that says it was wrong. I mean, I'm not a Marine any more (in the active sense)... I'm not a cop yet (I'm in the testing phase for the department here)... I'm just a civilian.

My sister told me that I should be expecting someone from the newspaper to come by or get a hold of me... that's going to be interesting. ... all I know is, I helped that woman and saved that baby. Even I had been arrested for it... I would have been satisfied. I'm glad the cops did see the story for what it was and made the decision they did.

I fined it VERY interesting that they would rather you have used a different wep. One swing with a bat is all it would have took to have killed the guy.

Good Rules to follow Gauwyn. Another I follow and try to pass on, (which given your service record i'm sure you do as well) is that you should not own a handgun unless you know your weapon.
I feel if you are going to own or carry, you should be able to field strip, clean, and accurately fire the weapon. This is going to mean a few trips to the range every now and again. Even though it likely violates the amendment a bit, I'd almost like to see gun training a requirement for ownership.

Though I personally do not own or carry, I do support amendment number 2 (I know many people who hunt/ carry handguns.)

but this thread isnt about the 2nd ammendment, so to get back on track...

I find it interesting too. It wasn't that I defended myself that they objected, or even that I carried a gun. The problem was that I used the gun as a club. Shame on me for hesitating and sparing some a-hole's life.

It really does seem that I would have been better off pulling the trigger. I had two witnesses that would have been able to testify that he threatend my life; had ability to inflict serious harm up to and including death upon me; and no avenue of flight or safety available.

That the law would lean to a lethal solution kinda freaks me out.

I think I understand the question, and to answer it simply...

... he was unjustly holding someone captive, and removing the baby from its' mother. As just an everyday citizen I felt it necessary to order him out of his vehicle so that she could get her daughter back.

To me it wasn't whether or not I had the right to order him... he had an opportunity to leave anyway and ignore me. But, he probably was scared, and decided to listen.

There is a law that states if someone breaks into your home, you are legally entitled to shoot them, but if they survive, you can be charged and convicted with attempted manslaughter. I know this to be fact because it happened to a relative of mine, who is STILL in prison over the thing happening.

You know what Gauwyn, yoy are the kind of marine that gives the core a good name. I dont like all these people giving marines crap about just being crazy war hunters and what not. My dad was a marine for 8 years, and my sister is in the marines now. They teach marines more than how to kill people, although, i think any drill seargent would feel grossly neglegent if the marines he trained weren't able to kill people. but that isn't what the marine core is about, its definetly about helping people like you did for that women. Semper Fidelis man.

We have similar laws up here in Pennsyltuky. Once they are in your home, fire away. But if they are tresspassing on your land with intent to burglarize and trip on a skate board, they can sue you.
